By using the Thats Live/Dialog Audio website ("Website"), you expressly agree to comply with the following terms and all applicable laws and regulations governing the Website. These terms form a legally binding contract between you and Thats Live/Dialog Audio. Thats Live/Dialog Audio and its respective affiliate (Stripe Payments Europe, Ltd) reserve the right to change these terms at any time and is effective immediately upon published on the Website. If you breach these terms, Thats Live/Dialog Audio may cancel your submission and block your access to the Website, cancel your ticket order, and/or take appropriate legal action against you.

Disclaimers

Thats Live/Dialog Audio cannot guarantee that the Website will be error-free, uninterrupted, or will provide specific results from use of the Website or any content, search or link on it. The Website and its content are published on a " wysiwyg" (what- you-see-is-what-you-get) basis. Thats Live/Dialog Audio disclaims any and all liability for the acts, omissions and conduct of any users and advertisers on the Website. Thats Live/Dialog Audio is not responsible for the products, services, or any artist or other third party in connection with or referenced on the Website. Thats Live/Dialog Audio disclaims all warranties, including any implied warranties of merchantability and suitability for a particular purpose. Thats Live/Dialog Audio will not be liable for any damages of any kind arising from the use of this Website, including without limitation, direct, indirect, incidental, and punitive and consequential damages.

Permitted Use

You agree that you are only allowed to visit and view pages of this Website for your own personal use, and that you are not authorized to copy, download, modify or otherwise distribute the content on this Website for any purpose other than to review event information, for personal use, or to purchase tickets for your personal use, unless otherwise specifically authorized by Thats Live/Dialog Audio to do so. Illegal uses of the Website, including, but not limited to, unauthorized ticket sales, or unauthorized use of any robot or other automated device on the website, may be investigated and appropriate legal action taken.

Currency

Ticket prices for all purchasers are indicated in U.S. Dollars.

Payment Methods

We accept several methods of payment to accommodate your needs. Thats Live/Dialog Audio accepts, among other forms of payment, American Express, Visa and MasterCard.

Order Confirmation

If you do not receive a confirmation email after submitting payment information, or if you see an error message, it is your responsibility to make sure whether or not your order has been placed. Only you may be aware of any problems that may occur during the purchase process. We will not be responsible for monetary losses if you assume that an order was not placed because you have not received confirmation, caused by your own fault.

Ticket-/ Link Transfer

We may cancel already provided tickets/links, at any time, if we determine that they were received in violation of our policies; If an event is canceled or rescheduled, only the original purchaser will be eligible for a refund.

Canceled or Postponed Events

Occasionally, broadcasting events are canceled or postponed. Should an event be canceled or postponed, we will attempt to contact you to inform you of refund for that event. For exact information on any canceled or postponed broadcasting events, please check the event details online or contact us. We will automatically issue you a refund to the credit card, debit card, or the method of payment used to make your purchase. If the broadcasting event was postponed, or rescheduled, the artist may set refund limitations.

Refunds

Before you purchase tickets for an broadcasting event, carefully review all event information. Policies determined by artists prohibit us from granting refunds after a ticket has been ordered. You agree that you will not attempt to circumvent or avoid any refund prohibitions with regard to tickets you purchased. You will not contact us to seek a refund from us when we are prohibited from providing one by its artists, and you will not dispute or otherwise try to receive a chargeback from the company whose credit card you used to order tickets. Should you do so, your tickets are subject to immediate cancellation, your account will be terminated. If we grant a refund for a ticket due to a canceled or postponed event, we will issue a refund of the ticket's value originally paid. Due to the unforeseeable amount of cancellations, please note that you should expect to receive refunds in as soon as 1 month. If the tickets were transferred to you, the refund will go to the purchaser who originally bought the tickets from Thats Live/Dialog Audio.

Account, Order, and Billing Information

All information on accounts and orders must be true and valid and are subject to verification. Orders that are made, or attempted to be placed, using an account in which any information entered is found to be misleading, incorrect, incomplete or cannot be verified, are subject to cancellation, at any time. Orders are subject to credit card approval and processed only after the billing address, connected with your credit card, has been verified.

Pricing/Errors

We sell tickets on behalf of different artists, which means we do not set the ticket prices. If the amount you pay for a ticket is incorrect regardless of whether because of an error in an announced price posted on this website or otherwise communicated to you, then we will have the right to cancel that order and refund to you the amount that you originally paid. This will apply regardless of whether because of human error or a transactional error of this website or the processors website (Stripe Payments Europe, Ltd).

Browser Windows

When purchasing tickets online, please make sure you are placing an order using only one browser window. Using more than one browser windows at the same time could result in losing your tickets, errors occurring during the purchase process, or timer expiration.

Recording, Transmission and Exhibition

Together with your friends you may listen to the virtual event solely for your own personal purpose. You may not record, copy, publicly present, transmit or distribute any broadcasting event through any means, or allow others to log into your account for the purpose of listening to a broadcasted event.

The Processor

The Processor of all transactions is Stripe Payments Europe, Ltd., organized under the laws of Ireland, which is a technical services provider and may offer the services as an agent of one or more financial institutions in Germany. The processor’s role is to accept and process credit card, debit card and other types of payments. The processing and settlement of transactions is carried out by Stripe Payments Europe, Ltd. and any of the Financial Services Providers under a separate Stripe Connected Account Agreement. This includes the German Stripe Services Agreement and the applicable Financial Services Terms, also if you use a payment method that is subject to additional terms, the Payment Terms. By accepting this agreement, you are also accepting and agreeing to comply with the terms of Stripe Payments Europe, Ltd, which is the legal agreement between you and the processor.

That’s Live/Dialog Audio is not a party to the processor’s terms and is not liable to you in respect thereof. By accepting this agreement and the processor terms you are agreeing to the opening of an account with the processor for payment processing. In the event of any inconsistency between this agreement and the processor’s terms, this agreement shall prevail, except in the event of any inconsistency between this agreement and the processor’s terms concerning payment processing or the processor account, in which case the processor’s terms shall be applicable.

Limitation on Liability

Except in jurisdictions where such provisions are restricted, in no event is Thats Live/Dialog Audio liable to you for any direct, indirect, consequential, exemplary, incidental or punitive damages.

Indemnity

You agree to indemnify and hold Thats Live/Dialog Audio, its affiliate, employees, and other partners, harmless from any loss, liability, claim or demand, including ‘attorneys' fees, made by any third party due to or arising out of your use of the Website.

Copyright

The content and software on this Website is the property of Thats Live/Dialog Audio and/or its suppliers and is protected by copyright. Except as expressly stated in the limited licence provision of these terms and conditions, Thats Live/Dialog Audio does not grant any express or right to you under any of its trademarks, copyrights or other proprietary information.

Trademarks

Thats Live/Dialog Audio logos found on this site are trademarks of Thats Live/Dialog Audio and may not be used at any time under any circumstances save with the prior written permission of Thats Live/Dialog Audio.

Governing Law

By using the Website, you agree that any dispute will be governed in accordance with German law and you agree to submit to the non-exclusive jurisdiction of the German Courts.
